How disputing works (FCRA 101)
You have a federal right to dispute anything inaccurate.
Your federal rights (FCRA in plain English)
The Fair Credit Reporting Act (15 U.S.C. §1681 et seq.) gives you the right to:
- See everything on your file (free at annualcreditreport.com)
- Dispute anything you believe is inaccurate, incomplete, or unverifiable
- Force the bureau to investigate within 30 days (45 if you add new info mid-investigation)
- Have unverifiable items deleted
- Sue for actual + statutory damages if they don't comply
The dispute lifecycle
You file a written dispute
↓
Bureau opens an investigation (within 5 business days)
↓
Bureau contacts the data furnisher (your bank/collector)
↓
Furnisher responds within ~25 days
↓
Bureau sends you the result within 30-45 days total
↓
If verified — you can escalate with method-of-verification (MOV)
If unverified — must be DELETED
If not responded to in time — must be DELETED
Why we always dispute in writing
- Verbal disputes via phone get "noted" and ignored
- Online disputes via the bureau portal waive your right to sue
- Mailed disputes via USPS Certified Mail create a paper trail and a legal clock
The escalation ladder
| Round | Letter type | Citation |
|---|---|---|
| 1 | Initial dispute | FCRA §611 |
| 2 | Method of verification | FCRA §1681i(a)(7) |
| 3 | Furnisher complaint + CFPB notice | FCRA §1681s-2 |
| 4 | Pre-litigation demand | FCRA §1681n / §1681o |
| 5-6 | Notice of intent to sue / file in small claims | Federal court |
